Hi,
Scenario:
House built at a lower level (2 meters) to an adjacent B road and public
footpath which has moderate traffic.A large hedge also runs along this
perimeter. The B road is not level but is on a slight hill and "dips" or
runs downwards for some 30 meters from a higher point.
Car and foot Access to the house is via a "private road" (up the hill)
which also runs parallel to the B road but has hedges and trees between.
Cars visiting the house may only enter a brick built garage on the house
property.The private road runs downhill to the house.
The next door neighbour will NOT allow cars to park up on the private
road outside his house. This is accepted and not challenged.
This requires visitors to either park in garage (if empty) or on the B
road. The B road is also frequently used for parking by visitors to a
Restaurant up the hill.
Question:
Would it be permissible to open a new "Gated footpath entrance" directly
through the hedge from the B road public footpath and is planning
permission required?
